New document spotlights alleged racial stereotyping

Unsealed Korn Ferry Profile Rekindles Brian Flores’ Discrimination Case Against the NFL

An unsealed candidate profile prepared by Korn Ferry for a recent head-coach search includes language that lawyers say relies on racial stereotypes about Brian Flores, a development Flores’ legal team argues strengthens the 2022 racial-discrimination lawsuit he brought against the NFL and multiple teams.

The document’s characterization of Flores prompted sharp responses from his attorneys. Steven Wigdor wrote that the materials reflect “two unfortunate, but unsurprising realities,” adding, “First, that Mr. Flores’ decision to hold the league and its teams accountable for systemic race discrimination has been met with unlawful retaliation. Second, discrimination continues to play a significant role in the hiring process for NFL Head Coaches, as evidenced by the fact that the candidate profile prepared for the Raiders leans heavily on racial stereotypes.”

Another lawyer, Michael Willemin, criticized the profile’s tone and specific passages, saying the report treated Flores’ intelligence “as though it is surprising for a Black man to be articulate (or in this case, polished).”

Flores filed his lawsuit in 2022 alleging racial discrimination by the NFL and multiple teams. The newly public Korn Ferry profile has been described in published reporting as potentially pivotal evidence in that litigation; one outlet characterized it as “a smoking gun.”

Legal fallout and questions about hiring practices

Flores’ complaint already centers on hiring and firing decisions he says were infected by racial bias. His lawyers contend the unsealed profile undermines the objectivity of internal evaluations that influence future employment opportunities, and they say the document’s blunt language could have real career consequences for Flores.

In court filings and public statements, Flores’ legal team has pointed to language such as an assessment that labeled Flores “the worst hiring decision we’ve ever made” as problematic. They argue that such characterizations can make it more difficult for a candidate to be hired for a head-coaching position and raise the question of whether those assessments were shaped, at least in part, by Flores’ decision to pursue litigation challenging his firing.

Legal analysts and observers have suggested the unsealed materials may prompt expanded discovery. It’s been noted that informal communications among owners and executives — emails, texts and other behind-the-scenes messages — could reveal additional context or corroborating evidence once they are produced in the case. One reporting outlet framed that possibility as a reasonable expectation for what Flores’ lawyers might uncover as discovery proceeds.

Some published coverage also raised the prospect that the Las Vegas Raiders could face consequences arising from the content of the Korn Ferry profile; that outcome was described in that reporting as a possibility rather than a settled fact.

What the filings allege and what remains to be proven

At the center of this strand of the litigation is Flores’ assertion that systemic race discrimination affects how NFL teams evaluate and hire head coaches. His legal team portrays the Korn Ferry profile as one piece of documentary proof showing racialized thinking in formal hiring materials. The claim that Flores’ decision to hold the league accountable was met with unlawful retaliation is presented by his lawyers as an allegation in the case.

Defendants in the broader litigation — the NFL and the named teams — have legal avenues to challenge those allegations, and the discovery process will determine whether internal communications and additional documents substantiate the lawyers’ view. Flores’ attorneys have publicly framed eradication of institutional racism and retaliation within the league as an objective of the litigation, describing themselves and their client as committed to that effort.

The unsealed Korn Ferry profile has intensified scrutiny of hiring practices at the highest levels of professional football and offers Flores’ legal team new material to press their claims. Whether the document proves decisive will depend on how the evidence uncovered in discovery fits together and how courts resolve the contested legal issues raised by the lawsuit.
